A Royse City man, previously charged with the possession of child pornography, is scheduled to plead guilty to another indictment.

Billy Lewis Malone Jr., 53, was taken into custody in October 2018 after an investigation by the Hunt County Sheriff’s Office and Royse City and Greenville police departments.

The Hunt County grand jury issued an indictment in the case Jan. 25 and Malone pleaded not guilty during a Feb. 15 arraignment hearing in the 196th District Court.

Judge Andrew Bench has scheduled a hearing to consider a guilty plea in the case for Dec. 11.

According to a report from the Hunt County Sheriff’s Office, a Royse City Police Officer conducting a routine traffic stop was provided computer items that allegedly contained images of child pornography in September. During the next two months, investigators with the three departments worked to gather evidence, which resulted in the recovery of multiple search warrants on computers and a residence in the 9000 block of County Road 2584.

An arrest warrant for possession of child pornography was served on Malone at the residence.

Malone was charged with multiple counts of possession of child pornography more than 15 years ago, was placed on probation after pleading guilty to a lesser charge and was also ordered to register as a sex offender.

Malone was indicted by the Hunt County grand jury in May 2004 on 10 counts of possession of child pornography, a second-degree felony punishable by a maximum sentence of up to 20 years in prison.

Malone eventually entered a plea of guilty in the 196th District Court to one count of displaying harmful material to a minor and was placed on five years of deferred adjudication probation.

The charge was a third-degree felony, punishable by a maximum sentence upon conviction of from two to 10 years in prison and a fine of up to $10,000.

Court records indicate Malone was released from state prison on parole on Sept. 23, 2011.

According to a criminal complaint filed with the Hunt County Sheriff's Office, a female acquaintance, who was living with Malone and her son at the residence on County Road 2584, found a disk containing images of child pornography on the home computer on Jan. 22, 2004. Later, more disks with the same type of material were discovered in a shoebox in a bedroom closet.

Malone was arrested by sheriff's investigators on an unrelated charge and later told investigators the disks belonged to him.

Malone’s probation in the earlier case was revoked in June 2016 and he was sentenced to six years in the Texas Department of Criminal Justice-Institutional Division.

Court records indicate Malone was released from state prison on parole on Sept. 23, 2011.

He was in custody Tuesday morning in the Hunt County Detention Center, being held in lieu of $100,000 bond on the child pornography indictment and no bond on a parole violation charge.

The current charge is also a third-degree felony.
